Stunning Lawsuit - NLCM Sues Mountain Home for $75 Million Dollars

UPDATE:  (Thursday June 2nd, 2011 at 11:35am)  There are rumors the asking price for this lawsuit is actually only $75,000. Only time will tell.

On May 31st, 2011 a law firm from Chicago, Illinois filed a 36 page document highlighting a lawsuit against the City of Mountain Home, the City Council and the City Manager. The Plaintiff for this lawsuit is the “No Limits Christian Ministries” located in the old Salvation Army Building in Mountain Home.

The Road to Hell is Paved with Good Intentions
I attended the key May 9th, 2011 City Council Meeting where the “Temporary” Conditional Use Permit (TCUP) was denied until the “No Limits Ministries” could gets its ducks in a row. This means they have to create adequate parking for the church members and and get their sewer/septic tank issues straighten out.

The lawsuit does mention “No Limits Ministries” tried to secure parking at nearby local businesses like Albertson's, Airman Pawn and a local strip mall. I understand there was an agreement to allow “No Limits” members to park in at least one of the above locations. But the agreement was revocable? In short, the business could just say “I don't want you parking on my property any more” at any time in the future leaving our City hanging. I believe during the City Council Meeting, this exact issue was voiced.

Rotting Fish Smell is Strong in Mountain Home
Former Mountain Home Mayor Joe McNeal spoke on behalf of “No Limits Christian Ministries” during the May 9th, 2011 City Council Meeting.

As I mentioned in a previous post, “I picked up on some weird nuances or hesitancy from the Council” while dealing with Mr. McNeal. What I meant by that statement was the Council explained every detail of their thought process “ad nauseum” and “ad nauseum” and “ad nauseum” to our former Mayor.

In all the meetings I've attended, the Council has never been as accommodating and patient with any other citizen...at least in my opinion.


Something is fishy in Mountain Home

Less than one month later, we see a $75 Million Dollar Lawsuit being filed against the City of Mountain Home? Something smells of dead fish in my opinion. And when something smells like an old and rotting dead fish, quacks like an old and rotting dead fish then likely the whole lawsuit needs to be taken care of like any person would treat a rotten dead fish.

No Limits Ministries Constitutional Rights Trampled On?
In the lawsuit, the brilliant mind educated at University of Chicago Law School and Yale invokes the 1st and 14th Amendment to the US Constitution as a reason the City of Mountain Home needs to let “No Limits Christian Ministries” open a full fledged church before the red tape is taken down. To me, “No Limits Ministries” rights are not being violated and the US Constitution is not being trampled upon...seems to me this lawsuit is using the US Constitution to trample on all the citizens of Mountain Home.

What Does $75 Million Dollars Mean to Us?
If “No Limits Ministries” wins the full amount in this lawsuit (doubtful):
- Every man, women and child in Mountain Home would have to cough up about $5,300 to pay off this lawsuit.
- “No Limits Ministries” could actually solve our housing market glut by buying 415 average sized houses in the city.
- They could solve the unemployment problem for one year by hiring 1,875 people to work for them for $40,000.
- Buy well over 1 ton of pure gold bars.
- Maybe even force Mountain Home into bankruptcy but I suspect there is some kind of insurance for this type of legal action?

Loss of Goodwill and No Limits on Legal Defense Costs
I suspect this “legal nudge with a sledge hammer” will act as a grease can to get the city to loosen up on the parking and sewer issue. But at what price? I suspect the City Attorney is already busy planning a defense. Do we really think this defense will cost the City of Mountain Home nothing? In the end, the only losers will be the taxpayers of our city. And any goodwill left for the “No Limits Christian Ministries” will be flushed down the sewer.

Lets make something perfectly clear...this lawsuit has nothing to do with the US Constitution or a persons race as the legal document seems to suggest. It has everything to do with “color” though. And that color is the color of money.
